Expressing Yourself With Your Finger

 

Family law and criminal law sometimes overlap, such as when one spouse stalks, harasses or threatens their former partner. There are provisions in the Criminal Code which allow the police to arrest a person for criminal harassment and uttering threats. 

All laws are open to some interpretation. What sort of behaviour is harassing? What constitutes a threat?

A Judge in Quebec was recently asked to decide whether to convict a man accused of harassing and threatening his neighbour. The man had given his neighbour two middle fingers.

The Judge not only acquitted the man, but said he was shocked that an arrest ever happened. 

In a decision that has made headlines across Canada, the Judge said that giving someone the middle finger is a "God-given" right that belongs to all Canadians.
